Terms of Service

These Terms of Service (“Terms”) govern your use of OpenSchool (the “Service”) and all content made available through it — including questions, answers, explanations, worked solutions, notes, flashcards, images, and other study materials (together, the “Materials”). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Your account
You are responsible for the information you provide and for keeping your account secure. You must give accurate details and are responsible for activity that happens under your account. Access to the Service and Materials is personal to you and non-transferable.
2. Subscriptions and billing
OpenSchool Pro is offered as a recurring monthly subscription and, where available, as a one-off Exam Pass. Prices are shown in Australian dollars. Recurring subscriptions renew automatically until cancelled, and you can cancel at any time to stop future renewals.
Payments are processed by Stripe. Except where required by law, payments are non-refundable. Cancelling stops future charges but does not refund the current billing period.
3. No AI, machine learning, or automated use
The Service and the Materials may not be used with, or provided to, any artificial intelligence, machine learning, or automated system in any way. Without limiting the general prohibition above, you must not, and must not permit, assist, or enable any other person or system to:
- use, access, copy, reproduce, or process the Service or any Materials to train, fine-tune, develop, test, evaluate, benchmark, validate, prompt, or improve any artificial intelligence, machine learning, large language model, neural network, or other automated or algorithmic system;
- input, upload, submit, paste, feed, or otherwise make any Materials available to any artificial intelligence, machine learning, generative, or automated tool or service, for any purpose — including to summarise, review, analyse, grade, translate, rewrite, or generate derivative or related content;
- use any bot, crawler, scraper, spider, headless browser, or other automated means to access, index, harvest, extract, or collect the Materials or any data from the Service; or
- carry out any text or data mining of the Materials, or use the Materials to build, populate, or enrich any dataset, index, or corpus.
We expressly reserve all rights in the Service and the Materials, including all rights to carry out text and data mining. We do not grant, and we opt out of, any exception or limitation that would otherwise permit text and data mining or AI/machine-learning use of the Materials, and this reservation applies regardless of any machine-readable or other signal. Any use described in this section is a material breach of these Terms and an infringement of our intellectual property rights, and may result in immediate termination of your access.
4. Other acceptable use
In addition to the restrictions above, you must not misuse the Service, including by attempting to disrupt it, access it without authorisation, resell or redistribute the Materials, or use it for any unlawful purpose. Access is for your personal, non-commercial study use only.
5. Content and intellectual property
The Service and the Materials are owned by us or our licensors and are protected by intellectual property laws. You receive a limited, personal, revocable, non-exclusive licence to use the Materials for your own study only. You may not copy, distribute, publish, sublicense, or create derivative works from the Materials except as expressly allowed in these Terms.
6. Educational disclaimer
OpenSchool is a study aid. While we work hard on accuracy, we do not guarantee any particular exam result or that all material is error-free, and the Service is provided “as is” without warranties of any kind to the extent permitted by law.
7. Limitation of liability
To the maximum extent permitted by law, OpenSchool will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service. Nothing in these Terms limits rights you have under the Australian Consumer Law that cannot be excluded.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access immediately if you breach these Terms — including the restrictions in section 3 — or use the Service in a way that could harm us, our licensors, or other users.
9. Governing law
These Terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of that state.
10. Changes to these terms
We may update these Terms from time to time. We will post the updated version here and revise the “last updated” date above. Continued use of the Service means you accept the changes.
